WHAT SHOULD I DO REGARDING MY TIER ASSIGNMENT?
Determine which of the above Tiers you or your family member will be assigned. Ask your Waiver Support Coordinator for the total spending on your current cost plan if you do not know your current spending for waiver services. Determine whether or not you will be taking a reduction in funding. If you were spending less than the spending limit for your Tier, you do not need to do anything. What if you are currently spending more than the spending limit for the Tier you are assigned? Talk with your WAIVER SUPPORT COORDINATOR AND THE PEOPLE PROVIDING SERVICES TO YOU. Can you reduce your current service use and still have your needs met? If that is the case, ask you Waiver Support Coordinator to work with you on adjusting your cost plan. Please note that if you determine that you will not use as many services from certain providers, you may have to change providers because they may terminate services. Let your service provider know what you are planning to do to adjust services. What if the Tier assignment makes such a drastic reduction in your spending limits that you cannot have your needs met? You have the right to file for a due process hearing. DO NOT ALLOW ANYONE TO TELL YOU THAT YOU DO NOT HAVE A RIGHT TO FILE. This is a difficult decision to make and only you can make the decision of whether or not you are prepared to file for a due process hearing.
